Three grand-ducal regulations concerning various aspects of maritime affairs have been published in the Memorial, the official journal in Luxembourg, dated 22 March 2012. An online version is available here.
The three new regulations are transpositions into national law of European directives which are part of the 3rd "Erika" package and address:
- common rules and standards for ship inspection and survey organisations and for the relevant activities of maritime administrations (transposition of directive 2009/15/EC),
- compliance with flag State requirements (transposition of directive 2009/21/EC),
- the insurance of ship-owners for maritime claims (transposition of directive 2009/20/EC).
Unfortunately the publication came on the very day the European Commission sent a reasoned opinion to Luxembourg for a failure to communicate transposition measures for directive 2009/21/EC on compliance with flag State requirements.
